for divorce a vinculo, on its own responsibility, without requiring any antecedent judicial proceedings. The Judicial Committee is armed with a very efficient machinery for the investigation of evidence. And considering the composition of the court (made up as it is of the highest authorities in all departments of the law), it is not, perhaps, too much to say, that it is better fitted than the House of Lords itself for the satisfactorily conducting of such inquiries. The entire transfer of Parliamentary Divorce to the Privy Council, in aid of the House of Lords, would diminish the expense of that remedy, and increase the business of the court, so as, with appeals, to furnish it with more than ample occupation throughout the legal year. In some of the United States, divorce a vinculo is granted by courts of equity on bill and answer. The Privy Council in former times administered relief in that form, and might do so again upon suits of divorce. For, dispensing with the action at law, and with the suit in the spiritual court, some record of the pleadings on both sides would be necessary; and, when occasion arose, an issue might be directed by the Judicial Committee, whose powers in that behalf, under the act, are the same, or larger than those of the Court of Chancery. In arranging this Treatise, it would perhaps have been better had the appellate jurisdiction of the Judicial Committee immediately succeeded the appellate jurisdiction of the House of Lords.
