The method of authenticating LETTERS of ATTOR NEY, and AFFIDAVITS in Great Britain, for the Recovery of Debts in the Colonies in America, with Forms of both forts.

B

EFORE the fifth year of King George the Second, the Legislatures of fome Colonies had paffed Acts of Affembly to make lands and Negroes there liable to the payment of debts, whilft others refused fo to do :on which feveral merchants in England that traded to the Colonies preferred a Petition to Parliament, and complained that in Virginia and Jamaica, a privilege was claimed to exempt their houses, lands and tenements, and their negroes also from being extended for debt; and the Lords of Trade reprefented, that the Affemblies of those Colonies could never be induced to divest themfelves of these privileges by any Act of their own. In confequence of this Petition, the Statute of Bb 2 5 Geo.

5 Geo. II. c 7. intitled, " An Act for the more eafy recovery of debts in his Majefty's Plantations "and Colonies in America," was made; by which it is enacted, That in any action or fuit then depending, or thereafter to be brought in any Court of Law or Equity in any of the faid Plantations, for or relating to any debt or account, wherein any perfon refiding in Great Britain fhall be a party, it shall and may be lawful to and for the Plaintiff or Defendant, and alfo to and for any witness to be examined or made ufe of in fuch action or fuit, to verify or prove any matter or thing by affidavit or affidavits in writing upon oath; or in cafe the perfon making fuch affidavit be one of the people called Quakers, then upon his or her folemn affirmation, made before any Mayor or other Chief Magiftrate of the city, borough, or town corporate in Great Britain, where, or near to which, the perfon making fuch affidavit or affirmation shall refide, and certified and tranfmitted under the Common Seal of fuch city, borough, or town corporate, or the Seal of the Office of fuch Mayor, or other Chief Magistrate; which oath and folemn affirmation, every fuch Mayor and Chief Magiftrate shall be and is hereby authorised and impowered to adminifter; and every affidavit or affirmation fo made, certified, and transmitted, fhall, in all fuch actions and fuits be allowed to be of the fame force and effect, as if the perfon or perfons making the fame upon oath or folemn affirmation as aforefaid, had appeared and fworn or affirmed the matters contained in fuch affidavit or affirmation viva voce in open Court, or upon a Commiffion iffued for the examination of witneffes, or of any party in any fuch. action or fuit refpectively; provided that in every fuch affidavit and affirmation there fhall be expreffed

preffed the addition of the party making fuch affidavit or affirmation, and the particular place of his or her abode

And by fect. 2. of the fame Act, it is enacted, That in all fuits then depending, or thereafter to be brought in any court of law or equity by or in behalf of his Majesty, his heirs and fucceffors in any of the faid Plantations, for or relating to any debt or account, that his Majefty, his heirs and fucceffors, fhall and may prove his and their debts and accounts, and examine his or their witnefs or witneffes by affidavit or affirmation, in like manner as any fubject or fubjects is or are impowered, or may do by this prefent act.

And by fect. 3. of the fame act, it is enacted, That if any perfon making fuch Affidavit, upon oath or folemn Affirmation, as aforefaid, fhall be guilty of falfely and wilfully fwearing or affirming any matter or thing in fuch Affidavit or Affirmation, which if the fame had been fworn upon an examination in the ufual form, would have amounted to wilful and corrupt perjury, every perfon fo offending, being thereof lawfully convicted, fhall incur the fame penalties and forfeitures, as by the laws and ftatutes of this realm are provided against perfons convicted of wilful and corrupt perjury.

And by fest, 4, of the fame Act, it is enacted, That the houses, lands, negroes, and other hereditaments and real estates, fituate or being within any of the faid Plantations belonging to any perfon indebted, fhall be liable to and chargeable with all just debts, duties, and demands of what nature or kind foever, owing by any fuch perfon to his Majesty, or any of his fubjects, and fhall and may be affets for the fatisfaction thereof, in Bb3

like manner as real estates are by the law of England liable to the fatisfaction of debts due by bond or other fpecialty, and fhall be subject to the like remedies, proceedings, and process in any Court of Law or Equity, in any of the faid Plantations refpectively, for feizing, extending, felling, or difpofing of any fuch houses, lands, negroes, and other hereditaments and real estates, towards the fatisfaction of fuch debts, duties, and demands, and in like manner as perfonal eftates in any of the faid Plantations refpectively, are feized, extended, fold or difpofed of, for the fatisfaction of debts.

A LETTER of ATTORNEY and an AFFIDAVIT certified under the Seal of the City of London, for the purpose of recovering a Debt in one of the Colonies, due to a Perfon in Great Britain.

TO all to whom thefe prefents fhall come, I William Bridgen, Efq; Lord Mayor of the City of London, in pursuance of an Act of Parliament made and paffed in the 5th year of the reign of our late Sovereign Lord King George the Second, intituled, An Act for the more easy recovery of debts in his Majefty's Plantations and Colonies in America, do hereby certify, That J-- Bof Upper Thames-ftreet, London, Clerk to JR of L---ftreet, London, Attorney at Law, being a perfon well known and worthy of good credit, did by folemn oath, which he took upon the Holy Evangelifts of Almighty God, folemnly declare, teftify, and depofe to be true, the feveral matters and things contained in the Affidavit hereunto annexed.
