grams pursuant to article 41 of the mental hygiene law, chapter 620 of the laws of 1974 as amended by chapter 660 of the laws of 1977, and other provisions of the

mental hygiene law.
Notwithstanding any other provision of law, advances and

reimbursement made pursuant to subdivision (d) of
tion 41. 15 and section 41. 18 of the mental hygiene law
shall be apportioned in а manner prescribed by the
agency head and approved by the director of the budget,
with copies of such approved plan filed with the
chairman of the senate finance committee and the
chairman of the assembly ways and means committee,
shall payment be made from any appropriation herein for
medical services until the recipient agency has demon-
strated that it has applied for and received,
received formal notification of refusal of, all forms of
third party reimbursement which may be appropriate for
such services. The moneys hereby appropriated
available to reimburse or advance localities and volun-
tary nonprofit agencies and community agencies for ex-
penditures made during local fiscal periods commencing
January first, nineteen hundred eighty-five, April
first, nineteen hundred eighty-five or July first,
nineteen hundred eighty-five, and for advances for the
three month period beginning January first, nineteen
hundred eighty-six. Notwithstanding any other provision
of law, up to two hundred sixteen thousand dollars
( $216,000) of this appropriation may be expended for
obligations incurred prior to April first, nineteen hun-
dred eighty-four. The comptroller shall create separate
accounts for each item in the schedule and each amount
shown below in a sub-schedule and control expenditures
of such funds accordingly. No expenditure shall be made
herefrom until a certificate of allocation has been ap-
proved by the director of the budget and copies thereof
filed with the state comptroller, and the chairmen of
the senate finance committee and the assembly ways and
means committee

This report shall include an analysis and summary of disability levels being served as well as a proposal for transitioning clients residing at private residential schools into appropriate modalities of residential care and proposed timetable for such transition. Such report shall be delivered by January fifteenth, nineteen hundred

eighty-six For additional services and expenses related

to private residential schools pursuant to a chapter of the laws of nineteen hundred eighty-five. Of the following amount million dollars (1,000,000) shall be used to improve the administration of private residential schools by extending support for such programs through contracts approved by the director of the budget through June thirtieth, nineteen hundred eighty-six. Additionally, three hundred thousand dollars (300,000) of such amount shall be used for cost of living increases

at such schools For state share of expenses of the ICF/DD

program, specialty hospitals services, and for habilitative services and

expenses heretofore and hereafter provided by local school districts to clients of communitybased intermediate care facilities for the developmentally disabled pursuant

to contract proposed by the commissioners of education and the office of mental retardation and developmental disabilities, and

approved by the director of the budget. Notwithstanding any

any inconsistent provision of law, the director of the budget shall make transfers from the moneys hereby appropriated to the department of social services medical assistance program for payments for intermediate

and

specialty hospital services for the developmentally disabled, at rates of payment certified by the commissioner of the office of mental retardation and developmental disabilities and approved by the

director of the budget For services and expenses related to home

care, including family support services Notwithstanding any other inconsistent

provision of law, for state aid of up to 100% of the net deficit costs related to

the provision of family support services including, but not limited to, the following: respite, crisis intervention, family support training and counseling, home modification, transportation, recrea

tion, and special adaptive equipment. The Commissioner of the Office of Mental

Retardation and Developmental Disabilities (OMRDD) shall, subject to the approval of the Director of the Budget, solicit requests for proposals from local governments or voluntary not-for-profit providers

for the provision of family support services to those families who care for developmentally disabled family members at

home. In reviewing applications for funding the

commissioner shall consider such factors as: program cost effectiveness; the provision of services to underserved persons including but not limited to the aging out, minority groups and those in geographic areas of need; and the ability of such proposals to offer long term, stable services. Such proposals,

implemented, shall be incorporated into local mental hygiene plans pursuant to article

41.00 of the mental hygiene law.
No expenditure shall be made from the fol-

lowing appropriation until the director of
the budget has approved of a plan submit-
ted to him by the Commissioner. Such plan
shall contain the following:
a. uniform standards to be appropriately

applied in determining client eligibil-
ity for family support services. Such
eligibility standards
