For hammering bevelled work, per cent. additional to plain work, but to apply only to the part cut off from the square work, and which is in no case to be measured in the plain work. For hammering of circular work, work. per cent. additional to plain Ninety per cent. of the amount of the work done and materials delivered, according to the contract price, (said amount to be ascertained by the estimate of the superintendent appointed for that purpose.) will be paid from time to time as the work proceeds, and ten per cent. retained until the completion of the contract and acceptance of the work, &c., by the superintendent aforesaid. Contracts will be awarded only to master builders or mechanics, and the assignment thereof, except by consent of the Secretary of the Treasury, will be a forfeiture of the same. Every proposal must be accompanied by a written guarantee, signed by two responsible persons, (certified to be so by the district attorney or judge of the said district,) that the bidder will, when required, if his proposals be accepted, enter into a contract and bond, with proper and sufficient securities, in the sum of fifty thousand dollars, for the faithful performance of the same, if for the whole work, and of a proportionate amount if for a part thereof. Any information touching the matter can be obtained by application to the Treasury Department. Proposals will also be received up to the aforesaid date for furnishing and delivering at the site, by the perch, the rough stone for the foundation, cellar, and area walls of said building, and must be of the very best description for that purpose. They will be required in such quantities and at such times as will be most for the convenience of the operation on the work, and in quality to the entire approval of the superintendent, the department reserving the right to reject the proposals hereby invited if the interest of the United States should require it. The proposals must be sent to this department, directed to the superintendent, under cover to the Secretary of the Treasury, indorsed. "Materials for the Treasury Building Extension," and will be opened at one o'clock p. m. of the last day fixed for receiving the same, in the presence of the bidders, if any choose to attend. Contract of Beal & Dixon for supplying granite. This contract, made and entered into between James Guthrie, Secretary of the Treasury, for and on account of the United States of America, of the first part, and Horace Beal and Courtlandt P. Dixon, of the city and State of New York, to whom was awarded the furnishing of the granite to be used in the extension of the Treasury building at Washington, D. C., on their bid for the same, received under the advertisement of Captain A. H. Bowman, superintendent of Treasury building extension, of June 26, 1855, of the second part, witnesseth: The parties of the second part covenant and agree to and with the party of the first part, for themselves, their heirs or administrators, to furnish and deliver (wrought and finished in a proper state to put into the building) all the material for the exterior walls of the south wing of the extension of the Treasury building. The stones must all be wrought to the dimensions, sizes, models, &c., which may be furnished by this department, and by which all measurements will be governed. The face of the ashlar must be perfectly wrought to the sample, with all necessary heads, rebates, returns, &c., required; the beds, builds, ends, &c., rough-hammered to the square. All rebates, mouldings, ornamental and bevelled work, must be clean-wrought, and agreeably to the directions given by the superintendent. The parties of the second part further covenant and agree to and with the party of the first part, Secretary as aforesaid, and for their heirs or administrators, to furnish and deliver all the said material, wrought and fitted as aforesaid, necessary for the exterior walls of the south wing of the extension of said Treasury building, agreeably to the plans, models, and specifications, under the direction of the superintendent, to be appointed by the Secretary of the Treasury for that purpose, and in conformity to the lithographed copies of the drawings of the several parts thereof, prepared at the office of the construction of buildings under the Treasury Department, which, together with the plans, models, and specifications aforesaid, are made a part of this contract, equally binding as if more particularly incorporated herewith; the whole subject to such omissions, additions, and alterations, as may be determined upon by the said party of the first part. And the said parties of the second part further agree and bind themselves, their executors, administrators, and assigns, to deliver the said material, wrought, fitted, and finished, as aforesaid, from time to time as the same may be required, according to the plans, models, drawings, and specifications aforesaid, and to the approval and acceptance of said superintendent, appointed as aforesaid; the whole to be delivered on or before the first day of October, eighteen hundred and fifty-seven. It is further agreed and understood that the granite to be used shall be the Dix Island granite, of the best quality, and that the dif ferent styles of cutting shall be in strict conformity with the samples. left at the Treasury Department by the said parties of the second part, and shall be executed to the satisfaction of the superintendent. It is also agreed and understood by the parties hereto, that the said parties of the second part shall deliver the said material, thereby contracted for, at the site of the said extension, and at such points as the said superintendent may designate, and at their own cost, risk, and expense. And the said party of the first part, Secretary of the Treasury as aforesaid, doth promise, covenant, and agree well and truly to pay or cause to be paid unto the said parties of the second part, their heirs, executors, administrators, or assigns, from time to time as the mate rial is delivered, (wrought, fitted, and finished as aforesaid,) ninety per cent. of the value thereof, said amount to be ascertained and duly certified to the department by the said superintendent, it being agreed and understood by and between the parties hereto that the remaining ten per cent. of the value of said material shall be retained until the final and entire delivery thereof, and its approval and acceptance as aforesaid by the said superintendent. And it is further agreed by and between the parties to these presents, that if, from any cause whatsoever, the said parties of the second part should fail to deliver the granite, wrought, fitted, and finished as aforesaid, with the required promptness, in the opinion of the said superintendent, to insure its completion by the time specified above, it shall become the duty of the superintendent, and he shall be, and is hereby, authorized and empowered, after eight days' due notice thereof in writing, left at the shop, office, or usual place of abode of the said parties of the second part, or with their agent, without effect, to purchase and procure the necessary materials, and have the necessary work performed to supply any deficiency caused by the delinquency of the said parties of the second part; and the actual cost thereof, together with fifteen per cent. thereon, shall be deducted. from any moneys due or owing to the said parties of the second part. on account of this contract; and if there is not that amount due them thereon, their bondsmen are to be held liable for any deficiency, to be recovered of them by suit in the name of the United States. It is also covenanted and agreed by and between the parties to this contract, that the said parties of the second part shall execute, with two or more sufficient sureties, a bond to the United States in the sum of fifty thousand dollars ($50,000) conditioned for the faithful performance of this contract and the agreements and covenants herein made by the said parties of the second part. Is is also agreed, covenanted, and understood by and between the parties hereto, that no member of Congress, or other person whose name is not at this time disclosed, shall be admitted to any interest in this contract. It is further covenanted and agreed by the parties hereto, that this contract shall not be assigned except by consent of the Secretary of the Treasury; and that any assignment thereof, except as aforesaid. will be a forfeiture of the same, and shall subject the said parties of the second part and their bondsmen to such damages, to be recovered of them by suit in the name of the United States, as shall have been suffered by the said party of the first part. It is also covenanted and agreed by and between the parties hereto. that in case any additions, omissions, or alterations are determined upon, the same shall be specifically noted hereon, and the amount to be paid or deducted therefor agreed upon and stated. It is also agreed and understood by and between the parties hereto. that the said parties of the second part are to furnish the material for the outside of the remainder of the Treasury building at the prices heretofore named for similar work when Congress may have made the |
