Oyston, then late of the same place, Gentleman, deceased, Thomas Burrows Oyston, of Westoe aforesaid, son of the said John Oyston, John Stinton, of the City of London, Boot and Shoe Maker, and Elizabeth, his Wife, formerly Elizabeth Oyston, Spinster, Francis Pace, of South Shields, aforesaid, Sail Maker, and Jane Sophia, his Wife, formerly Jane Sophia Oyston, Spinster, William Brown, of the same place, Gentleman, and Ann, his Wife, formerly Ann Oyston, Spinster, Charlotte Oyston, Catherine Boldron Oyston, and Harriett Oyston, all of Westoe aforesaid, Spinsters, which said Ann Oyston, Thomas Burrows Oyston, Elizabeth Stinton, Jane Sophia Pace, Ann Brown, Charlotte Oyston, Catherine Boldron Oyston, and Harriett Oyston, were the Widow and Children and Executors of the Will of the said John Oyston, deceased, of the second part, the said Thomas Masterman Winterbottom, of the third part, and Henry Anderson (therein described), of the fourth part, ALL that piece or parcel of ground, part of a certain close and gardens, called the Butts, situate on the East side of Westoe Lane, near the Town of South Shields, and hereinafter particularly described, and intended to be hereby appointed and released, WAS appointed, granted, released, and conveyed unto the said Thomas Masterman Winterbottom and his heirs, NEVERTHELESS, TO THE USE of such person or persons, for such estate or estates, interest or interests, and to and for such intents and purposes as he, the said Thomas Masterman Winterbottom, by any deed or deeds, should from time to time or at any time appoint, AND in default of and until such appointment, TO THE USE OF the said Thomas Masterman Winterbottom, and his assigns, during his natural life, without impeachment of waste, and after the determination of that estate by any means in his life time, To THE USE OF the said Henry Anderson and his heirs, during the natural life of the said Thomas Masterman Winterbottom, In TRUST NEVERTHELESS, for him and his assigns, and after the determination of the estate, so limited in use to the said Henry Anderson and his heirs as aforesaid, To THE USE OF the said

Thomas Masterman Winterbottom, his heirs, and assigns for ever, AND the said Thomas Masterman Winterbottom did thereby declare that no woman who might happen to become his widow should be entitled to dower out of the said purchased premises. AND WHEREAS the said Thomas Masterman Winterbottom is desirous of assuring the said parcel of ground and premises unto the said several persons, parties hereto, of the second part, upon and for the trusts, intents, and purposes hereinafter declared of and concerning the same, Now THIS INDENTURE WITNESSETH that in pursuance of the said desire, the said Thomas Masterman Winterbottom by virtue of his said recited power and of every other power, enabling him in this behalf, DоTH by this deed appoint, and DoтH hereby also grant and release unto the said Robert Ingham, Richard Shortridge, Joseph Hargrave, Robert Anderson, and Terrot Glover, and their heirs, ALL that piece or parcel of ground, part of the said close and gardens called the Butts, situate on the East side of Westoe Lane, near the Town of South Shields, and containing in length from North to South on the West end thereof eighty three feet, and on the East end thereof eighty two feet, and in breadth or depth from East to West on the North side thereof seventy eight feet, and on the South side thereof sixty nine feet, and late in the occupation of the said William Alderson, BOUNDERING on the North on an intended street to be called Alderson Street, on the South on an intended street to be called Ingham Street, on the East partly on an intended Back Street to be nine feet wide, and partly on other part of the close and gardens belonging to the said William Alderson, and on the West on Westoe Lane aforesaid, and which piece or parcel of ground and intended streets are described in a plan indorsed on the in part recited Indenture of the twenty ninth day of April last past, ToGETHER with the free use and enjoyment of the said intended streets and all other ways, and all buildings, trees, hedges, ditches, fences, waters, watercourses, lights, easements, privileges, advantages, emoluments, rights, members, and appur

tenances whatsoever to the said parcel of ground, and hereditaments expressed to be hereby appointed, and granted, and released, belonging or in anywise appertaining or used or enjoyed therewith, or accepted, reputed, deemed, taken, or known as part, parcel, or member thereof, or of any part thereof, AND the reversion and reversions, remainder and remainders, yearly and other rents, issues and profits thereof, AND all the estate, right, title, interest, property, claim, and demand whatsoever at law and in equity of the said Thomas Masterman Winterbottom, of, in, or out of the said hereditaments and premises and every part thereof, To HAVE AND TO HOLD the said parcel of ground and other the premises expressed to be hereby appointed, and granted, and released unto, and to the use of the said Robert Ingham, Richard Shortridge, Joseph Hargrave, Robert Anderson, and Terrot Glover, their heirs and assigns for ever, NEVERTHELESS upon and for the trusts, intents, and purposes hereinafter declared of and concerning the same. PROVIDED ALWAYS and it is hereby declared that in case the said several persons parties hereto, of the second part, or any of them, or any other trustee for the time being of these presents, shall cease to reside within ten miles of the said parcel of ground and premises expressed to be hereby appointed and released, then and in such case the trustee or trustees so ceasing to reside as aforesaid, shall forthwith cease to be a trustee or trustees of these presents as if he or they were actually dead: BUT this proviso is not to extend or apply to the said Robert Ingham. And it is hereby agreed and declared that upon the death of the said several persons parties hereto, of the second part, or any of them, or any other trustee or trustees for the time being of these presents, or in case they or any of them shall decline to act in the trusts of these presents, it shall be lawful for the said Robert Ingham and Richard Shortridge, during their lives, and for the survivor of them during his life, and after the decease of such survivor then for the trustees or trustee for the time being of these presents whether continuing or

declining to act, or for the executors or administrators of the last surviving trustees, by any instrument in writing under hand and seal to appoint a new trustee or trustees in the room or place of the trustee or trustees dying or declining to act as aforesaid: And it is hereby expressly declared that no act, except the appointment of a new trustee or trustees, shall be done or performed by the trustees or trustee for the time being of these presents as trustees or trustee thereof, when the number of trustees of these presents shall be reduced below three. And it is hereby agreed and declared that the said several persons parties hereto, of the second part, and the survivors and survivor of them or other the trustees or trustee for the time being of these presents, shall stand seized of the said parcel of ground and premises expressed to be hereby appointed and released in trust, to permit the same to be used for the purpose of a school, to be called "The Marine School of South Shields, " and to be established and conducted according to the following statutes or rules :

THAT the Bishop of Durham for the time being shall be the visitor of the said school.

THAT the Dean of Durham and the several incumbents for the time being of the parishes or parochial chapelries of Saint Hilda, Jarrow, Boldon, Whitburn, and Monkwearmouth, all in the said County of Durham, together with the trustees for the time being of these presents, and six merchants or shipowners, to be chosen as hereinafter mentioned, shall be the governors of the said school.

THAT the six merchants or shipowners, to be chosen as hereinafter mentioned, shall be the committee of the said school.

THAT the committee of the said school shall be chosen and continued in manner following, that is to say, that when and

so soon as the trustees for the time being of these presents and the said several incumbents, or the majority of such trustees and incumbents, assembled at a meeting called for the purpose by the said trustees or some or one of them, shall be of opinion that sufficient funds have been obtained for the erection of a suitable building or buildings on the said parcel of ground for the said school and for the maintenance thereof, the said trustees and incumbents, or the major part of them so assembled as aforesaid, shall select twelve merchants or shipowners, resident within the Borough of South Shields aforesaid, not being trustees of these presents, who shall be willing to act as governors and as the committee of the said school, and that the names of such twelve merchants or shipowners shall be written upon twelve similar pieces of card or paper and put together into a box or bag out of which the incumbent of Saint Hilda, and in his absence, some one or other of the said several other incumbents and trustees nominated by the majority of them, shall draw out of the said box or bag six of the said pieces of card or paper, and the persons whose names shall be found written on the cards or papers so drawn out shall be governors and the committee of the said school for the time being, and shall respectively continue in office until their respective deaths or until their successors are appointed as after mentioned.

THAT the names of the six persons so chosen by lot shall be placed in a list one after another in alphabetical order.

THAT at the annual general meeting of governors, held pursuant to these presents in the month of February next after the committee shall be first chosen as aforesaid, and so at the annual general meeting of governors, held in the month of February in every succeeding year, a list of six merchants or shipowners, resident within the said Borough, and not being governors of the said school, and willing to act as governors and as committee of the said school, shall be selected
