IN THE YEAR OF OUR LORD ONE THOUSAND EIGHT HUNDRED AND

FORTY-FOUR.

AN ACT in addition to an act in relation to Ferries.

Be it enacted by the Senate and House of Represen2 tatives in Legislature assembled as follows:

SECTION 1. No person or persons shall establish, 4 keep or maintain in this State any free ferry at or 5 near any ferry which has been, or may hereafter be 6 established by law.

SEC. 2. If any person shall establish, keep or main2 tain any free ferry contrary to the provisions of the 3 first section of this act, or shall transport passengers 4 or teams, at or near any ferry which has been or may 5 hereafter be established by law in this State, so as to 6 divert the ordinary travel from such lawfully estab7 lished ferry and reduce the amount of toll which 8 would otherwise be received thereby, he shall forfeit 9 the sum of four dollars for each day he shall keep or 10 maintain such free ferry, or for each time he shall 11 transport passengers or teams as aforesaid.

SEC. 3. When any person having passed over any 2 ferry lawfully established in this State, shall neglect

3 or refuse to pay the toll due for that time passing, the 4 same having been demanded by the ferryman at the 5 time of passing, he shall forfeit the sum of one dollar 6 in addition to the amount of toll due as aforesaid.

SEC. 4. No provisions contained in this act shall be 2 so construed as to prohibit citizens from crossing at 3 any place where a ferry may be established in this 4 State, either themselves or with their families in their 5 own boats.

SEC. 5. Any forfeiture mentioned in this act may 2 be recovered by complaint before any justice of the 3 peace to the use of the state.
